Regulation on Further Deepening the Real Estate Registration Service Reform and Setting up a Dedicated Service Area for Enterprises

To natural resources title confirmation and registration service centers (real estate registration service centers), tax bureaus and real estate transaction centers (real estate transaction management service centers) of all districts,

In order to continuously improve the property registration procedures and the business environment of Shanghai Municipality and enhance the sense of gain of enterprises and people, relevant matters are hereby announced as follows:

I. Objective

Adhering to the principle of centering around applicants and “effectively handling registration” for enterprises and people, we

should make efforts to further deepen the real estate registration service reform and complete the tax payment and processing procedures for the registration of real estate transfer between enterprises on the spot in accordance with the decisions and arrangements made by the CPC Central Committee and the State Council for bolstering the reforms that streamline administration and delegate power, innovate supervision and optimize services, as well as the requirements of the Shanghai Municipal Committee of CPC and the Shanghai Municipal Government for promoting the optimization and restructure of hundreds of service procedures.

II. Tasks

(1) Setting up a dedicated service area for enterprises

On the basis of the achievement of the real estate registration service reform in 2019, that is, the on-the-spot completion of procedures for registration of transfer of plants and warehouses, efforts shall be made to further expand registration categories and include the registration of real estate transfer between enterprises into the services provided by the dedicated windows. All districts shall set up a dedicated area for processing the registration of real estate transfer between enterprises in office halls of registration centers. Eye-catching colors and marks shall be used in the area to reasonably guide enterprises and individuals to separately handle registration procedures. All districts shall provide a reasonable number of service windows in the area according to the actual conditions, so as to meet the needs of enterprises and the people to the greatest extend.

(2) Integrating application, tax payment and certificate-issuing

procedures

The transaction, tax and registration procedures shall be further integrated and optimized to enable the transaction authorities, the tax authorities and the registration authorities to complete the review of real estate transactions, settle all tax-related matters and complete the registration review on the spot respectively, thus completing all procedures for registration of real estate transfer between enterprises (including those for applying for registration, paying the taxes and obtaining the certificate) at one time.

(3) Shortening the time required for handling registration

Upon adjustment, the handling the registration of real estate transfer between enterprises shall be completed on the spot (less than 90 minutes), and the progress will be published on the website of Shanghai Municipal Bureau of Planning and Natural Resources in real time for supervision by the public.

(4) Cancelling online signing of purchase and sale contracts between enterprises for non-residential stocking houses

According to the Announcement on Matters Concerning Registration of Taxes on Real Estate Transactions for Purchase and Sale of Non-residential Stocking Houses between Enterprises (H.J.F.G.L No. 171 [2019]), the online signing of purchase and sale contracts between enterprises for non-residential stocking houses shall be cancelled. Therefore, applicants can apply for the registration with self-drawn contracts.

III. Requirements

As the real estate registration service reform is critical for the

optimization of business environment, natural resources title confirmation and registration service centers (real estate registration service centers), tax bureaus and real estate transaction centers (real estate transaction management service centers) of all districts shall highly value the reform, work together to boost the reform, make greater efforts to publicize the dedicated service area for enterprises, complete relevant tasks according to the stipulated steps and the same criteria applied in Shanghai Municipality within the stipulated time, and make sure to process registrations and issue certificates in the same window.

The Shanghai Municipal Bureau of Natural Resources Title Confirmation and Registration, the Shanghai Municipal Tax Service and the Shanghai Municipal Bureau of Housing Management will cooperate with the General Office of the State Council, the Shanghai Municipal Committee of CPC and the Shanghai Municipal Government to carry out special inspections on the optimization of business environment in accordance with the No. 8 document issued by the General Office of the State Council and the requirements announced by the inspectors to check if there is any additional processing procedures or any action that fails to comply with the unified requirements applied in Shanghai Municipality, and take the improvement of the experience and policy awareness of enterprises and the people as one of the indicators for performance appraisal of all districts.

This Regulation shall come into force from January 1, 2020.
