In order to further deepen the comprehensive reform of real estate registration, improving service, and building a market-oriented and lawful international business environment, the Chongqing Municipal Bureau of Planning and Natural Resources, Chongqing Municipal Commission of Housing and Urban-Rural Development and Chongqing Tax Service, State Taxation Administration have made the decision to jointly launch the “Applying at One Window, Getting the Result on the Spot ” service to facilitate the transaction, registration and taxation of existing home sales.
I.Objective of the Work
The objective of this work is to provide the public a new service to facilitate the transaction, registration, taxation of existing home sales in Chongqing. In accordance with the "Regulations on Optimizing the Business Environment", this new service integrates the services of real estate transaction registration, and taxation that were handled at three different places into one comprehensive service and be handled at one window only. After the applicant submits the required documents, and after he or she pays the relevant taxes and fees, he or she can obtain the real estate registration result on the spot.
II. Specific Measures to Carry out This Work
All local authorities should ensure the actualization of this service through setting up comprehensive service windows, streamlining the collection of required documents, and shortening the processing time .
A.Setting up comprehensive service windows
The authorities responsible for real estate registration, housing and urban-rural development, tax service should jointly set up comprehensive service windows to handle real estate transaction, registration, tax appraisal, tax payment, tax payment registration, and the issuance of certificate of title at once.
The number of these comprehensive service windows is to be determined accordingly provide that it can meet the demand of “ applying at one window, getting the result on the spot”. Coordinated effort should be made to staff the comprehensive service windows -- the personnel can come from the local real estate registration centers, or real estate transaction centers, or tax services.
B.Streamlining the collection of required documents
The collection of required documents for real estate registration, transaction and taxation must be further streamlined. Staff working at the comprehensive service windows are not allowed to demand the applicant hand in documents that are not required by the law, official regulations or rules. If a document is needed by the three parties -- real estate registration, housing urban and rural development and tax service -- the client needs to provide the comprehensive service window one copy only, and the document should be copied and archived by the other parties requiring it. If the original document is required for on-site verification, the comprehensive service window staff should not ask the applicant to provide duplicates; instead, they should make copies of the original document themselves.
Documents required for real estate registration,transaction and taxation, and service fees should be displayed on the official website of Chongqing Municipal Government, the official websites of relevant departments and real estate registration halls.
C.Shortening the processing time
In principle, application for registration of existing home transfer (including residential and non-residential) submitted to the comprehensive service window (including mortgage and transfer registration) by an enterprise or an individual should be completed on the spot, but not under the following circumstances:
a.Public notification is required according to the law or regulations.
b.Some required documents are missing.
c.The applicant has a dispute on the item of service.
III. Requirements Regarding the Work
All local authorities must understand the significance of optimizing business environment, deepening the comprehensive reform of real estate registration, and work hard to upgrade management concepts and methods and improve service capability and efficiency.
A.Ensuring effective and timely implementation of this work. All local bureaus, commissions, and tax services should report this work to the local government and party committee to win their support. The local authorities are also required to learn from each other to improve the work and prioritize this “applying at one window, getting the result on the spot ” service. Organizational work should be strengthened to ensure the work be effectively and efficiently tackled. Relevant municipal authorities must inspect and supervise the implementation of this work at the local level.
B.Enhancing coordination. The local bureaus of planning and natural resources, commission of housing and urban-rural development, tax services, and real estate registration centers should cooperate with each other to advance the work in a coordinated manner to achieve deep integration of the three departments.
c.Pushing forward with internal staff training and public publicity. The time is pressing and the workload is heavy. All local authorities should familiarize the staff with the new business procedures required by this new service. The procedures of this new service should be placed or videoed in a conspicuous place in the service hall, so that the public can learn about relevant information easily. It is necessary to use local mainstream media to publicize this new service and ensure that the public and professional agencies be informed of the progress of this work.
d. Improving the communication channels. Local authorities should take stock of typical cases and practices in a timely manner and report to higher level authorities. Major issues arise from implementing this work and important public opinions should be reported to the higher level authorities, the local government and the local party committee on time to avoid fluctuation of public opinions triggered by this new service.
This regulation is effective from the date of issue.
